Judicial Districts

There are 8 judicial districts in New Brunswick, each of which corresponds to a King’s Bench trial courthouse. Judicial districts in New Brunswick are divided by county. They are:

  • Bathurst (Gloucester county)
  • Campbellton (Restigouche county)
  • Edmunston (Madawaska county, Parish of Drummond, and the town of Grand Falls)
  • Fredericton (York, Sunbury, and Queens counties)
  • Miramichi (Northumberland county)
  • Moncton (Albert, Westmorland, and Kent counties)
  • Saint John (Charlotte, Kings, and Saint John counties)
  • Woodstock (Carleton and Victoria counties excluding the Parish of Drummond and the Town of grand Falls).

The rules of court say you must use a specific judicial district depending on why you are going to court. for example:

  • In family law matters involving children, you go to court in the judicial district where the children live
  • For small claims matters, you usually go to court in the judicial district where either the problem happened or where the defendant lives. There are some exceptions to this, though
  • In matters involving property like real estate, you go to court in the judicial district where the property is
  • For probate matters, you usually go to court where the deceased person lived or where they owned property

If you are not sure which judicial district to use for your legal matter, you should get advice from a lawyer.

For family matters, some judicial districts use different Rules of Court than others. This means that the forms are different in these regions, and some of the rules for court documents and timelines are also different.

The Judicial Districts of Bathurst, Campbellton, Edmundston, Fredericton, Miramichi, and Woodstock follow Rule 72 and Rule 73 of the Rules of Court for family law matters.

The Judicial Districts of Saint John and Moncton use a different Rule of Court called Rule 81, and use different court forms.

For family law matters, you must file your application in the judicial district where you live or where the child lives. If you and the child live in different judicial districts, then you should file where the child lives.
